四川省富顺县人民法院复查谢德堪“恶霸罪”的刑事判决书

原判被告人谢德堪（又名谢田），男，判刑时56岁，汉族，四川省富顺县人。

富顺县人民法庭于1951年3月14日作出第11号刑事判决，认定谢德堪犯恶霸罪，判处死刑。

经本院复查查明：原判认定谢德堪犯恶霸罪证据不充分，判处其死刑属错杀，应予纠正。据此，改判如下：

撤销原富顺县人民法庭1951年3月14日第11号刑事判决中对谢德堪以恶霸罪处以死刑的判决。
